images.events is a platform that enables event photographers to share their photos with event guests and facilitates the ordering of printed and framed photographs. Our service includes:

• Photo hosting and sharing capabilities for photographers
• E-commerce functionality for print and frame sales
• Order management and tracking
• Print fulfillment services
• Payment processing for photographers

3. User Accounts

3.1 Photographer Accounts

As a photographer using our service, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Only upload content that you own or have the right to distribute
• Ensure all uploaded photos comply with applicable laws and regulations
• Accept responsibility for all activities under your account

3.2 Guest Accounts

Event guests may browse photos and place orders. By placing an order, you agree to:

• Provide accurate shipping and payment information
• Pay all charges associated with your order
• Accept our standard shipping and return policies

4. Photographer Responsibilities

Photographers using our platform agree to:

• Upload only photos for which they hold copyright or proper licenses
• Not upload content that is illegal, obscene, defamatory, or infringes on third-party rights
• Obtain necessary model releases and permissions for commercial use
• Respect the privacy rights of individuals photographed
• Provide accurate event information and photo descriptions

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to photos and content you upload. By uploading content to images.events, you grant us a limited license to:

• Store, display, and distribute your photos through our platform
• Process and fulfill orders for prints and frames
• Use thumbnail images for promotional purposes related to our service

5.2 Our Platform

The images.events platform, including all software, design, text, and graphics, is owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, or reverse engineer any part of our service.

6. Payment and Pricing

6.1 Photographer Earnings

Photographers earn a percentage of each sale made through their event galleries. The specific earnings percentage is displayed in your dashboard and may vary based on:

• Product type (print size, frame selection)
• Promotional pricing
• Volume discounts

6.2 Payment Processing

We use third-party payment processors to handle transactions. Photographer earnings are paid out according to our standard payment schedule (typically monthly). You agree to:

• Provide accurate payment information
• Pay any applicable taxes on your earnings
• Accept that payment processing fees may apply

6.3 Refunds and Cancellations

Orders may be cancelled within 24 hours of placement. Once production has begun, orders cannot be cancelled. Refunds for defective products will be issued at our discretion.

7. Print Fulfillment

We partner with professional print labs to fulfill all orders. We strive to deliver high-quality products but cannot guarantee that prints will exactly match on-screen colors due to monitor variations. Standard processing and shipping times apply.

8. Prohibited Conduct

You agree not to:

• Use the service for any illegal purpose
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Harass or abuse other users
• Manipulate pricing or engage in fraudulent activities
• Scrape or download content in bulk without permission
• Impersonate another person or entity

9. Content Moderation

We reserve the right to review, remove, or refuse to display any content that violates these terms or that we deem inappropriate. However, we are not obligated to monitor all content uploaded to our platform.

10. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent activity
• Extended periods of inactivity
• At your request

Upon termination, you may lose access to your content and any pending earnings below our minimum payout threshold.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

Our service is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or completely secure.

11.2 Limitation of Liability

To the maximum extent permitted by law, images.events shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless images.events from any claims, damages, or expenses arising from:

• Your violation of these terms
• Your violation of any third-party rights
• Content you upload to our platform

13. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of significant changes via email or through the platform. Continued use of the service after changes constitute acceptance of the modified terms.

14. Privacy

Your use of images.events is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

15. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and images.events regarding the use of our service.

20. Referral Program Terms

The images.events Referral Program allows registered users to earn rewards by referring new photographers to our platform. By participating in the Referral Program, you agree to the following terms:

20.1 Eligibility

• You must have an active images.events account in good standing to participate
• You cannot refer yourself or create multiple accounts to earn referral bonuses
• Referrals must be new users who have never previously registered on images.events

20.2 Referral Rewards

• You will earn a $25 bonus for each referred photographer who signs up using your unique referral link and completes their first sale
• The referred photographer must make a legitimate sale (not a self-purchase or fraudulent transaction) for you to qualify for the reward
• Rewards are credited to your account within 30 days of the qualifying sale
• There is no limit to the number of photographers you can refer

20.3 Prohibited Activities

The following activities are strictly prohibited and will result in immediate disqualification from the Referral Program, forfeiture of all pending and earned rewards, and potential account termination:

• Spam, unsolicited bulk messaging, or any form of harassment to promote your referral link
• Posting referral links in misleading or deceptive contexts
• Using paid advertising that includes our brand name or trademarks without permission
• Creating fake accounts, using bots, or making fraudulent purchases to earn referral bonuses
• Colluding with referred users to generate fake sales or chargebacks
• Using stolen credit cards, fraudulent payment methods, or engaging in money laundering
• Manipulating or exploiting any technical vulnerabilities in the referral system
• Referring users who subsequently engage in fraudulent or abusive behavior
• Any other activity that we determine, in our sole discretion, to be abusive, fraudulent, or harmful to the program

20.4 Fraud Detection & Enforcement

• We employ automated and manual fraud detection systems to monitor referral activity
• We reserve the right to delay reward payouts for up to 90 days to verify the legitimacy of referrals and sales
• If a referred user's sale is refunded, charged back, or determined to be fraudulent, the associated referral reward will be revoked
• We may require identity verification before issuing rewards
• Suspicious patterns of activity (e.g., multiple referrals from the same IP address, unusually high referral volumes, referrals with no genuine sales activity) will be investigated and may result in account suspension
• We reserve the right to pursue legal action against participants who engage in fraud, including seeking damages and recovery of improperly obtained rewards

20.5 Program Modifications

• We reserve the right to modify, suspend, or terminate the Referral Program at any time without prior notice
• We may change the referral reward amount at any time; changes will not affect rewards already earned
• We reserve the right to disqualify any participant and withhold or revoke rewards if we suspect fraud or abuse

20.6 Tax Responsibility

You are solely responsible for any taxes applicable to referral rewards you receive. We may require you to provide tax information (such as a W-9 form for US participants) before issuing rewards above certain thresholds.

20.7 Liability Limitation

• images.events shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Referral Program
• Our total liability for any claims related to the Referral Program shall not exceed the total referral rewards you have earned in the 12 months preceding the claim
• We are not responsible for technical issues, delays, or errors that may affect referral tracking or reward distribution

20.8 Indemnification

You agree to indemnify, defend, and hold harmless images.events, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your participation in the Referral Program, your violation of these terms, or your violation of any rights of a third party.

20.9 Relationship

Participation in the Referral Program does not create an employment, agency, partnership, or joint venture relationship between you and images.events. You are not authorized to make any representations or commitments on our behalf.
